Legal development of global aviation carbon emission reduction and its implications for China

Abstract:Although the carbon emissions of aviation are not too high, they are growing rapidly and there are high-altitude emissions characteristics, so the aviation industry has become the focus of global carbon emission reduction. The EU directive 2008/101/EC has taken the lead in reducing carbon emissions from aviation, but progress has been slow due to legal flaws. The International Civil Aviation Organization's carbon offsetting and reduction scheme for international aviation, which faces numerous hurdles, will be implemented in 2021. China should seize the opportunity to promote the development of domestic legal system of aviation carbon emission reduction, and actively fight for the right of international discourse. On the one hand, China should formulate a basic law on climate change, include carbon tax into the scope of environmental protection tax collection, and promote the legalization of carbon emission trading to lay the institutional foundation of aviation carbon emission reduction law. On the other hand, China should focus on designing and promoting the development of low-carbon aviation technologies and operations, rationally allocating aviation carbon emission quotas, and forming a legal framework for aviation energy prices based on carbon emissions trading.
