Abstract: The image of bisexual people in the perspective of social culture and history has not been recognized by law, which is rooted in the influence of gender dual paradigm on law in medicine, that is, the overall inheritance of gender dual paradigm in medicine. At present, medicine has begun to disinfect androgynous people, in essence, the binary gender paradigm has been abandoned, but law is still stagnant on gender issues. The dual gender paradigm of law leads to the abuse of gender change surgery and the gender space in public places, which challenge the social identity, equal protection and other human rights of bisexual people. The dual gender paradigm also poses a difficult problem for the application of gender-related legal system in departmental law. Legislation should abandon the existing gender dual paradigm and recognize the legal status of the third sex. The fundamental way lies in the reform of the gender system of household registration and identity cards, and popularizes the specific departmental laws on the basis of determining the third legal status.
